As a public interest initiative, IMI’s goal is to generate enhanced confidence in mediators and improved understanding of mediation. Not a service provider or a peak body, IMI convenes the world’s thought leaders to achieve these goals. IMI Certified mediators are openly searchable.

Ireland's National Mediation Conference Symposium hits Headlines

The National Mediation Conference Symposium, held in Dublin on March 5, 2010, hit the News when Michael Gorman presented the results of his study into Ireland's legal spend on litigation.

Mr Gorman, of training organisation Friarylaw, had conducted the study comparing the status quo in Ireland with a programme in the US state of Oregon, which used mediation instead of litigation for disputes involving State parties, saving up to 85% of litigation costs. He presented his findings at the Symposium, held at Dublin’s Trinity College, concluding that up to 200million euro could be saved by the Irish Government through the use of mediation rather than litigation. Difficult financial and economic conditions have cast a spotlight on Government spending in Ireland.

IMI Chair 2010

Patrick Deane, Senior Counsel and Head of the Alternative Dispute Resolution Practice at Nestlé, has been appointed 2010 Chair of the IMI Board of Directors.

Michael McIlwrath, Senior Counsel – Litigation, GE Oil & Gas, who has served as the 2009 Board Chair, will remain a member of the IMI Board.

Being an accredited mediator himself, Patrick is a strong advocate of the use of mediation as an effective tool for resolving commercial disputes and the application of mediation techniques to resolve deadlock and conflict in difficult negotiations. An Australian citizen, Patrick is based at Nestlé’s international headquarters in Vevey, Switzerland.

Commenting on his appointment, Patrick said:

“The time has come for mediation to be recognised as a true profession in its own right. With its increased use to resolve all types of conflicts, users of mediation services should be able to make informed choices, with meaningful information, based on a common set of standards. In this way proper assessments and comparisons can be made based on the needs of the users.

The reason why I gladly accepted the offer to lead IMI in 2010 is that IMI is in a unique position to provide transparency for users of mediation services and in so doing promote mediation and share knowledge and best practice in a complimentary way with other institutions, mediation services providers and thought leaders worldwide."

IMI publishes Annual Review of its operations for 2009

After almost two years of planning, consultation and preparation IMI advanced hugely and became a practical reality in 2009 as a public resource.  By December, IMI’s Certification Scheme had been successfully introduced and had attracted over 1,000 experienced professional mediators.  IMI's Annual Review covering 2009 looks back at its work over the past year and looks forward to further progress in 2010 for mediation to expand more quickly into a global profession and to be used wider in conflict resolution and dealmaking.

The latest development in Hong Kong Civil Justice Reform creates a framework for encouraging mediation

Hong Kong, January 1,  2010
A Practice Direction (PD-31) introduced as part of Hong Kong's ongoing Civil Justice Reforms encourages parties to attempt to resolve their dispute by mediation as a precursor to all civil court proceedings.  In addition to filing mandatory certificates to confirm they have been fully advised about mediation, parties are able to serve a formal Mediation Notice setting out their willingness to mediate.  If served, the counter-party must serve a Response, and any refusal to mediate must be supported by reasons.  PD-31, which also includes cost implications, came into effect on 1 January 2010 and is aided by a Mediation Information Centre supported by a dedicated website to facilitate parties taking their disputes to mediation.

Mediators attend COP15 United Nations Climate Change Conference

Copenhagen, December 10-11, 2009

Under the auspices of Mediators Beyond Borders and Nordic Mediators, 100 mediators from 20 nations participated in a two-day seminar at Glyptoteket in Copenhagen, alongside the COP15 United Nations Climate Change Conference. This was the only mediation presence as an NGO official observer organization at the COP15. The focus of this initiative is to create an infrastructure to secure the use of mediation in climate change conflicts.

CPR to launch online evaluation scheme for CPR Neutrals

CPR Institute  is planning to launch a scheme to enable users to evaluate the performance of the members of its Distinguished Panel of Neutrals, which is composed of both mediators and arbitrators.  CPR is partnering with an online appraisal initiative, Positively Neutral, to  incorporate PN's model as a tool into the CPR website to help the corporate and law panel users select arbitrators and mediators from the CPR Distinguished Panel of Neutrals.

The scheme, which is voluntary, involves CPR panelists providing Positively Neutral with a list of references from proceedings over the past two years.  PN will then ask those users to respond to a series of questions about the panelist's performance, and also to rank their performance on a four-point scale ranging from excellent to unsatisfactory.  Neutrals will be given an opportunity to review the results and choose to publish all or none of the ratings .  If published, the appraisals and ratings will be accessible to CPR members via the panelist's Profile on the CPR subscriber-only website.

ICC’s 5th International Commercial Mediation Competition - application process now open

ICC has opened the online application process for another round of its International Commercial Mediation Competition.

Universities and professional mediators are invited now to apply to participate in the 2010 Mediation Competition. Going into its 5th year, the Competition is open to law schools from all over the world. ICC expects to hit a new record in 2010 with around 50 universities and over 85 mediation professionals participating.

With a view towards training lawyers to better meet the dispute resolution needs of today's cross-cultural market, the Competition gives students an opportunity to test their problem-solving skills in an international mediation moot. Professional mediators with a diverse range of expertise will participate as volunteer mediators and judges.

The competition will take place in Paris on 6-10 February 2010.

SOUTH AFRICAN HIGH COURT OBLIGES LAWYERS TO GO TO MEDIATION

On 25th August 2009 the High Court in Johannesburg held in the case of Brownlee v Brownlee that the failure by attorneys to send a matter to mediation at an early stage should be visited by the Court’s displeasure. The Court deprived them of their full attorney and client fees and limited them to the costs that they could recover on the lesser party and party scale.

Whilst only the attorneys were deprived of their costs, the risk now exists that parties who unreasonably refuse to mediate will also be deprived of their costs. This risk and the inherent merits of mediation will no doubt drive South African attorneys and their clients into the process and mediation will in time become an integral part of our civil justice system.

IMI Registrations Top 1,000 Worldwide
IMI Moves on to Certification by Assessment

IMI completed its Experience Qualification Path on June 30 2009.  Over 1,000 experienced mediators from 35 countries took the opportunity to register on the IMI portal during the EQP period.  

Already, over 100 mediators have completed their Profiles and are searchable on IMI's open-access search engine.  That number is expected to grow to almost 1,000 within 3 months.  Registered mediators have until September 30 2009 to complete their Profiles.  

With the help of a 50-strong Independent Standards Commission, IMI is now moving on to implement Criteria that entities need to meet in order to be authorized to qualify experienced mediators for IMI Certification in the future.

IMI's Chairman, Michael McIlwrath of General Electric said:

“This is a truly great milestone from provably experienced mediators!  Access to such an impressive number around the world will satisfy the needs of users for credible and convincing data about competent mediators.  More than that, it is significant step in a drive by stakeholders to expand the mediation pie by injecting more confidence and understanding into mediation practice, and give it standing as a truly global profession. Future steps will be to promote the portal’s search engine to users worldwide to identify competent and suitable mediators for disputes, and to leverage the IMI experience to expand and extend the uptake of mediation in different countries and markets.”

IMI is now inviting top trainers, providers, professional and educational institutions to consider the Criteria established by the Independent Standards Commission and apply for authorization to deliver assessment programs qualifying experienced mediators for IMI Certification on a wider scale.
 

New Certification for Experienced Mediators in France

The Académie de la Médiation, a body convening judiciary, lawyers, commercial disputants  and mediators, has announced the creation of the Institut Français de Certification des Médiateurs (IFCM). The IFCM is an independent non-profit body designed to certify the competency of experienced mediators based on advanced skills assessments conducted by an independent entity. IFCM has a mission to apply the highest standards and assessment processes and tools developed in France and internationally.
 

Highly Qualified Panel of Legal and Accountancy Experts formed to help Resolve Commercial Disputes

The Institute of Chartered Accountants of England & Wales and the Alternative Disputes Resolution Group (ADRg) have joined together to launch a mediation service that brings together a highly-qualified and experienced panel of eminent professionals from the legal and accountancy professions.  Their new “resolving commercial disputes” service has been developed in response to an anticipated increase in commercial disputes coupled with pressures to reduce litigation costs through mediation as a result of the economic downturn. The panel at the heart of the “resolving commercial disputes” service brings together senior lawyers and accountants trained in mediation and dispute resolution. The service is intended for major companies facing complex commercial disputes that result in protracted and costly litigation.

Mediate.com Announces Mediator Certification Program

Mediate.com has announced a Certification Scheme for mediators. Under the scheme, mediators are required to file a disclosure of non-confidential information detailing their training and mediator case experience. To be Certified by Mediate.com requires a minimum of 100 hours of training and 500 hours of case experience. Other requirements include disclosure of professional liability insurance, a log of at least 12 hours continuing education, identification of professional organization affiliations, adherence to defined standards of mediation practice, and an indication of references.

Focus on IMI at the 12th UIA World Forum of Mediation Centers

The World Forum of Mediation Centers was created in 2001 by the Mediation Commission of the UIA - Union Internationale des Avocats (International Attorneys Association).

Melding Corporate Social Responsibility and Mediation - A New Interactive Resource On Dispute Resolution Mechanisms

On 6 January 2009, the UN Secretary-General’s Special Representative for Business and Human Rights, Professor John Ruggie, announced the launch of BASESwiki: a new on-line resource that aims to advance awareness about the non-judicial mechanisms available around the world to help companies and their (non-commercial) external stakeholders resolve disputes.  BASES – Business and Society Exploring Solutions – is an initiative of the SRSG in collaboration with the Corporate Social Responsibility Initiative at Harvard Kennedy School, the International Bar Association, and the Compliance Advisor/Ombudsman of the World Bank Group.  This global,
interactive forum enables anyone – businesses, communities, mediators, lawyers, non-governmental organizations, academics, governments and others  - to share, access and discuss information about these mechanisms and the resources and experts that can support their use.

The Mediator Directory opens online search engine of UK Mediators

London, January 5th 2009

The publisher of The Mediator Magazine  has created an online Mediator Directory. The Directory currently carries the resumés of over 70 UK mediators and these are fully searchable by anyone who registers on the site. The cost to a mediator of featuring a resumé on the site is £120 per annum and searches are free of charge. In a first for the UK, parties may file attributed feedback on any listed mediator directly onto the site. Those carrying their resumés on the Directory may use the TM-Transparent Mediator kitemark. There are no competency qualifications for inclusion on the Directory, which is not directly aimed at defining minimum standards but rather at improving users’ choice and the information available to them about mediators.

UK's CMC Publishes Draft Registration Schemes for Mediators and Provider Bodies

The Civil Mediation Council (CMC) in London has published for comment draft schemes for registering mediators and mediation provider organizations.

The CMC is a non-profit entity established in 2003 at the collaborative instigation of leading mediation providers and practitioners, professional institutions, practitioners and the Ministry of Justice. It's main object is to "create a culture of best practice by encouraging research, continuing education and quality standards in the field; by issuing codes of good practice; and by conducting accreditation of mediation providers and through them individual mediators". The current chair of the CMC is Sir Henry Brooke, formerly vice president of the Civil Division of the Court of Appeal of England & Wales. Karl Mackie, CEO of CEDR is the current CMC Vice-Chair. To date, 48 mediation organizations have been registered under a pilot voluntary accreditation scheme that was started in December 2005.

The pilot scheme was suspended following a CMC announcement in mid-November 2008 of two voluntary registration schemes - one for provider organizations and one for individual mediators. At the same time, the CMC published draft Codes of Good Practice - one for mediation providers and one for individual mediators. The CMC has also announced that a registration process for mediation training organizations, and a Code of Good Practice for trainers, will be introduced in 2010.

When the CMC initially announced these voluntary registration schemes, they intended to have them enter into force on January 1st. 2009. However, comments to the CMC are now invited by the end of January 2009, and an Extraordinary General Meeting of the CMC has been scheduled for March 30 2009 to finalize and adopt these schemes.

Changes to the IMI Board and Independent Standards Commission

The Hague, 19 December 2008

In line with IMI practice to rotate the Board Chair each year, Wolf von Kumberg of Northrop Grumman Corporation, who has served as the IMI Board Chair throughout 2008, will step down as Chair but remain a member of the IMI Board.  Michael McIlwrath, Senior Counsel – Litigation, GE Oil & Gas, who currently serves as a Vice-Chair of the IMI Independent Standards Commission, will take over as Chair of the IMI Board of Directors on 1 January 2009.

Mike will therefore withdraw from his role as a Vice-Chair of the Independent Standards Commission while Judith Meyer will continue as a Commission Vice-Chair.  To emphasize the diversity and geographic spread of the Commission’s leadership three well-known mediation professionals – Eileen Carroll, Geoff Sharp and Bruce Whitney, have agreed to serve with Judy as Joint Vice-Chairs of the Commission, and Prof. Tommy Koh will continue as the Commission’s Chair.

IMI Independent Standards Commission Joint Vice-Chairs - 2009:

Eileen Carroll is Deputy Chief Executive of CEDR in London and is responsible for CEDR Solve’s dispute resolution services.  Eileen has been mediating since 1988 and has written and lectured extensively on mediation around the world.  She has a great deal of mediation experience, including on very high profile disputes, and is co-author of the book International Mediation – The Art of Business Diplomacy.

 

Judith P. Meyer has served as a Vice-Chair of the Independent Standards Commission since its inception.  Judy is the principal in JPMeyer Associates in Haverford PA and is a full time commercial mediator.  In addition to being a hugely experienced and accomplished mediator, Judy has taught mediation at Cornell Law School for the past 10 years.  She is a Fellow of the International Academy of Mediators, a member of both the American College of Civil Trial Mediators and the American College of Arbitrators and a member of many mediation and arbitration panels, including those of AAA Mediation, Construction Dispute Resolution Systems, the US-China Business Mediation Center and the CPR Distinguished Panel of Neutrals.  Judy sits as a Settlement Judge Pro Tem for the Commerce Court of Philadelphia.  She has been voted a SuperLawyer in each of the past 4 years and is listed in Best Lawyers in America in ADR.

 

Geoff Sharp is a full time practicing mediator based in Wellington, New Zealand.  A Barrister and former Chair of the NZ Law Society ADR Committee, Geoff is a member of the LEADR Advanced Panel, the Specialist Panel of Mediators of AMINZ and the HKIAC Panel of Mediators.  Geoff is a Fellow of the International Academy of Mediators and was recently made LEADR Australasia Fellow, only the third mediator to hold that key leadership privilege.  Geoff finds time to host one of the best and most visited blogs in the field:http://mediatorblahblah.blogspot.com/.

 

R. Bruce Whitney was until retirement recently the Chief Litigation Counsel of Air Products & Chemicals Inc, a world leader in the supply of industrial gases and equipment, speciality and intermediate chemicals and environmental and energy systems.  Bruce personifies the modern in-house counsel approach to dispute management, has been an extensive user of ADR services internationally, and was one of CPR Institute’s earliest supporters and champions.  He is a member of the Executive Committee of the Corporate Counsel International Arbitration Group, of the Chief Litigation Counsel Association and the International Association of Defence Counsel.
 

CEDR Awards for Excellence in ADR - Innovation & International

MICHAEL MCILWRATH of General Electric, joint Vice-Chair of the IMI Independent Standards Commission, won the 2008 CEDR Award for Excellence in the Innovations Category for his International Dispute Negotiation podcasts which were judged to provide thought-provoking content on important issues for the ADR community.  To access the podcasts on mediation please click here.

The CEDR Award for Excellence in the International Category was won by TOKISO DISPUTE SERVICES.  CEDR cited Tokiso as a pioneer in the commercial field, building on a long tradition in labour disputes, having worked to establish best practice and created a sophisticated professional development structure, whilst promoting stimulating debate on ADR in the media of South Africa.  Tokiso is listed in Category 2 of the IMI Experience Qualification Path.

IMI Presented at the 9th biennial Australian National Mediation Conference in Perth, September 9-12, 2008

Irena Vanenkova outlined the upcoming IMI mediator competency certification scheme at a plenary session of the Australian National Mediation Conference, the first to be held since Australia introduced National Mediation Standards on January 1st 2008.  To download the presentation slides, please click here.   In his comments closing the Conference, Hon. Justice Murray Kellam AO, Chair of the Australian National ADR Advisory Council (NADRAC), offered the following comment to those still doubtful about the need for competency standards for mediators:   "With the standards in place the opportunities for development are significant. For example, the National Mediator Accreditation System is broadly compatible with the proposed international standards established by the International Mediation Institute and it is important for Australian mediators to have a clear path to international recognition. The National Mediator Accreditation System will assist mediators to do this.  It is time for mediators from all walks of life to look at the common goal first and to their individual goals and positions second.  We all have to give a little so we can reap the benefits."

Mediation Knol - Finding an International Mediator

Finding an International Mediator is one of the first mediation Knols. Authored by Michael McIlwrath, a Vice-Chair of IMI's Independent Standards Commission, the Knol raises the issue of identifying suitable candidates to mediate an international commercial dispute. The Knol is an extract from the forthcoming book to be published by Kluwer Law International in 2009 on International Dispute Resolution co-authored by Michael McIlwrath of GE and John Savage of Shearman & Sterling.

In December 2007, Google created a new tool called Knol (meaning a unit of knowledge). Similar to Wikipedia, a Knol differs in a number of ways -- a Knol on a subject identifies the author and can be contributed to by anyone, but the authors or their designees can veto changes and additions. Finding an International Mediator is set up as an open Knol to invite edits to the article. Those edits will be moderated by a group of 5 invited experts: Wolf von Kumberg of Northrop Grumman Corporation, IMI Chairman; Diane Levin, Boston-based mediator and publisher of Mediation Channel blog and the Directory of ADR Blogs; Jeremy Lack, Geneva-based mediation advocate with Altenburger; Melanie Meilhac, director of the ICC's ADR services [provisional] and Giovanni Nicola Giudice, director of mediation services for the Court of National and International Arbitration of the Milan Chamber of Commerce.

Members of the Legal Committee of the American Chamber of Commerce in The Netherlands voted to express their views on mediator competency certification.

Amsterdam, June 5th 2008

Members of the Legal Committee of the AmCham in The Netherlands, overwhelmingly comprising users of mediation services, received a presentation by Michael Leathes on IMI's work to date, and following a discussion were then asked the same 12 questions put to the AAA Annual Meeting on May 9th. They were not shown the AAA Annual Meeting results until after they had voted.

Delegates at AAA Annual Meeting use electronic voting to express their views on mediator competency certification

Washington DC, May 9th 2008

Participants at AAA's 2008 Annual Meeting spent two hours focusing on mediator competency certification. Presentations by Wolf Von Kumberg of Northrop Grumman Corporation, Nancy Lesser of PAX ADR LLC, Christopher Honeyman of Convenor Conflict Management and Michael Leathes of IMI were followed by a discussion. Then 12 questions, with a selection of multi-choice answers, were posed to the delegates who used individual electronic keypads to register their opinions on the subject in secret ballot format.

In November 2007, Herbert Smith published the results of a survey called The Inside Track - How Blue-Chips Are Using ADR. The Survey covered in-depth responses from 21 corporations having combined gross sales of over $800 billion. See the Survey results, plus an ADR Toolkit prepared by the firm in light of the research to assist in-house counsel make better use of ADR.

Wolf Von Kumberg Appointed Chair of IMI

IMI is pleased to announce that Wolf Von Kumberg has accepted an invitation to become Chairman of IMI’s Board of Directors

imi.jpgWolf von Kumberg is European Legal Director and Assistant General Counsel for Northrop Grumman Corporation. He has offices in both London and Zurich, holds dual Canadian and German nationalities and speaks several languages. He is qualified as a lawyer in both Canada and England and has spent over 20 years as first a litigation lawyer and then as in-house counsel to several Global Aerospace Companies. He has extensive experience in international dispute resolution, and is a prominent user of mediation services. Wolf is a Fellow of the Chartered Institute of Arbitrators and a member of CEDR, CPR and the LCIA.
