Mediation Profile

Tax and regulatory litigation partner, business and tax mediator.

I have worked for many years in an international law firm (Baker & McKenzie) and my practice slowly moved from transactions, to litigation, to mediation. Currently I combine my law practice with a mediation practice. I am a honorary judge at the tax court in The Hague and a part time professor at the University of Leiden. I am president of the Dutch Association for Tax Mediation, I am a board member of the Dutch Association for Business Mediation and I am a board member of Tribute, a foundation for International Tax Dispute Resolution. In 2013 I published a book in The Netherlands together with 2 other authors about Mediation in Tax Matters (SDU 2013).

As of 2008 I am certified as Mediator in The Netherlands with the NMI and now with the Mfn (its successor), as a Registered Mediator and I am also registered as a mediator in the International ADR register. Some cases are referred to me by the court. I was part of the pilot project "mediation in bankruptcy cases" that was initiated by the Amsterdam court. I am also regularly asked to mediate in cases where complaints are filed against tax advisors with their professional regulatory bodies. I have been acting as mediator in over 50 cases.

My mediation style is more evaluative that facilitative, in any case not transformative. Parties generally like the idea that I would have knowledge of the specific legal/tax side of the problem and that helps me to focus on the real problem and the real solutions.

Most of my mediations are in tax matters and in financial matters, like insolvency cases, and in conflicts in all kind of joint ventures and partnerships. Internationally I expect to do more mediation in tax matters and in investment conflicts, as Tribute, the foundation for international tax dispute resolution, has entered into an agreement with the Permanent Court of Arbitration in The Hague for these cases, and today I am one of the few tax lawyers that may act as a mediator in cross border conflicts.

My hourly fee rate depends on the kind of case and the (financial) interest of the case. It will be somewhere between EUR 250 and EUR 400,- , VAT to be added in due.

Complaints can be filed with Mfn. They have a process for that.
