Mediation Profile

Carol Powell is a private mediator in her own practice. Carol is the Chair of LEADR New Zealand: Association of Dispute Resolvers, a not-for-profit organisiation formed to serve the community by promoting and facilitiating the use of consensual dispute resolution processes. She also sits on the Board of LEADR which is based in Australia. She is also the New Zealand representative on the LEADR Accreditation Committee. Carol is also very active in the mediation world in New Zealand. Among her many roles, Carol was a Member of the New Zealand Law Society ADR Committee (1999 – 2004), she was a member of the organising committees for the very successful LEADR 9th International ADR Conference held in Wellington in 2007. She is also a member of the committee which set up the Waitakere Community Mediation Scheme. Carol is the Deputy Chair of the Electricity and Gas Dispute Resolution Services Board of Directors. Carol is also a lead trainer for LEADR and offers training through her own practice. Carol is also co-author of the New Zealand Section in Brookers Australasian ADR Service” first edition; Author of the Alternative Dispute Resolution Section of the Auckland District Law Society’s Legal Practice Manual and Editor of the New Zealand Law Journal ADR section. Carol has a legal background having practised for over 15 years in commercial civil litigation.

Carol has been mediating for the past 15 years in a wide variety of areas. She is on the LEADR Advanced Mediators Panel and is an Accredited Australian National Mediator. She was an AMINZ Fellow (2001 - 2006). Carol is on a number of panels which refer mediation work including: Weathertight Homes Resolution Service Mediation Panel; Health & Disability Mediation Panel; Family Court mediation pilot – North Shore Court Panel; and Domain Name Commissioner Mediation Panel. Carol is also a mediator for the University of Auckland. Carol also undertakes private mediation, training, facilitation and systems design.

I use a facilitative model of mediation which focuses on enabling the parties to have the conversations they need to have to explore and understand the problem (including both the substantive and psychological), and then to consider options before looking for a way forward that meets their needs and interests. I remain facilitative throughout and do not offer solutions or assessment of options. I spend time with the parties separately as required both prior to mediation and during the process. During these private sessions the parties are able to raise issues that may be difficult for them and to consider alternatives to a mediated agreement in detail. The negotiation phase is conducted with the parties together. The goal of my mediations is for the parties to walk away feeling that they understand the problem and have made an informed decision that they can live with, without coercion, as to the best course of action for them in all of the circumstances.
Carol has mediated a wide range of disputes including: Education, workplace, neighbourhood, health and medical, business, parenting issues, sexual abuse, civil and commercial issues including aviation, construction and engineering, Weathertight homes, partnership, franchising, intellectual property, trusts and estates, harassment and bullying relationship property, domain name ownership and corporate issues.

Carol is a trainer for LEADR in New Zealand and has co-trained in the LEADR 5-day (previously 4-day) course since 1994 as well as training bespoke courses and micro skills. Carol also trains regularly for the Ministry of Justice, the University of Auckland, the Department of Building and Housing.
