Mediation Profile

Constantin-Adi Gavrila, the founding member and CEO of ADR Center Romania, former co-chair of the  International Mediation Institute's Independent Standards Commission, IDC’s 2009 International Outstanding Leadership Award Recipient, Association for Conflict Resolution, Advisory Council’s member of the Lord Slynn of Hadley European Law Foundation, London UK, first president of the Romanian Mediation Centers Union and vice-president of the first Mediation Council, is an engineer, a jurist, and a mediator, dedicating a great part of his professional activity to mediation, ADR management, dispute resolution system design and mediation training since 2002. 

Adi has been gaining experience as a mediator since 2002, helping clients from numerous countries to resolve domestic or international disputes. Thus, individuals, companies, and lawyers have trusted Adi to successfully design and manage the mediation of family, labor, civil or commercial disputes, both domestic and international. At the same time, communities, private organizations, public authorities, governments, and Independent Accountability Mechanisms (IAMs) have entrusted Adi with facilitating complex dialogue processes, with the involvement of multiple parties and stakeholders interested to discuss the social and environmental impacts of projects funded by international financial institutions.

He has supported ADR and mediation projects for organizations like the Council of Europe, the International Development Law Organization, the Forestry Stewardship Council, the International Organization for Migration, several governments from Asia, Europe, the Middle East, and Africa, and the independent accountability mechanisms of the World Bank, the EBRD, the EIB.

Adi has served as a mediator in a wide variety of complex cases with the Craiova Pilot Mediation Center since 2002 and as a professional mediator ever since. He has extensive experience in supporting individuals, groups, companies, governments and international organizations in addressing a wide variety of cases, both domestic and international.

Representative domestic cases include:
  * Real estate multi-party case involving banking procedural and methodological updates; 
  * Complex defamation dispute between doctors;
  * High-value case regarding determining, valuing, and dividing marital property;
  * Contract dispute case over the cancellation of a purchase agreement.

Adi is also an active mediator in the development space and has worked, for example, with the Compliance Advisor Ombudsman (CAO), the Independent Project Accountability Mechanism (IPAM), and the Complaints Mechanism (CM), the IFC/MIGA (World Bank), EBRD and EIB accountability mechanisms to facilitate dialogue processes between the bank clients and communities concerned about the environmental and social impacts of bank-financed projects. Examples of multi-party cases supported by Adi are:
  * Seismic impacts and other E&S concerns of communities regarding the technology of the oil & gas sector;
  * Air quality impacts of steel companies;
  * Risk of landslides related to HPP construction works;
  * Community resettlement related to the expansion of mining activities;
  * Impacts of public transportation projects for pedestrian accessibility.

Adi's mediation style can best be described as impartial, neutral, supportive, proactive, patient, creative, and tailored to each client and situation. Although he feels closer to the facilitative style, Adi tries not to label the overall style that he uses because it also includes transformative, narrative and evaluative approaches and methods.

Training and Education

Adi understands that permanent learning is key for a good mediator. This is why he takes every opportunity to build his knowledge and top up his skills through formal training or other tools such as co-mediation, peer review or shadowing. 

Additionally, continuous mediation practice provides with excellent learning opportunities.

Adi is also learning from students and young mediators he is coaching.

Adi has trained over 1,000 mediators and mediator trainers in Europe, Asia, the Middle East and Africa. Additionally, Adi has successfully trained mediation advocates, judges, to refer cases to mediation, and mediation users to ensure an appropriate and constructive framework. Adi's clients usually are international institutions, governments, ministries, or chambers of commerce.

Adi's knowledge, skills and experience were enriched with a taste for research. Having the experience of a failed mediation legislation in Romania, mandatory for the plaintiff before going to court, with a hard and unbalanced sanction of case inadmissibility, Adi's appetite for research concluded in a constitutional law thesis, "Mediation and Access to Justice". This reason and others have prompted Adi to speak at many mediation events since early 2000s.
