Mediation Profile

Adjunct Professor of Law (Administrative Law and ADR) Notre Dame University, Sydney Australia. I am a Barrister at Law, admitted to practice in 1978. I practice law in Australia. I am empanelled as mediator and arbitrator including at the Royal Institute of Chartered Surveyors (Arbitrator and Mediator), Asian International Arbitration Centre, Dubai Mediation Centre panel the Florence Mediation Centre panel. I have mediated matters in South East Asia and Australia. I lecture on mediation theory, skills and practise. In October 2016 I gave a memorable seminar to 120 lawyers at the Mongolian Bar Association. My areas of practice are litigation, mediation and arbitration with a professional and academic background in environmental law, international law, international and domestic arbitration, commercial disputes and land law disputes. My specialties at the Bar are Environmental Law and Dispute Resolution through Mediation, Arbitration in environmental and land law issues including compensation for land resumption. I am well attuned to the benefits of dispute resolution through effective mediation. I have mediated disputes involving numerous parties and many nationalities. I am well familiar with the complexities of cultural issues and multi-party issues which may arise in mediation from time to time. My motivation as a mediator is that a resolution arrived at by parties in mediation is more effective and more economical than litigation and offers the opportunity for ongoing commercial and personal relationships. I have attended and completed mediation theory and practise units at Sydney University, IAMA (Canberra ACT), Harvard University, Bond University, EMTPJ Brussels. I am an IMI and CEDR accredited mediator and a Fellow of the Chartered Institute of Arbitrators. I am the Chairman and Managing Director of the International Alliance of Mediators and Arbitrators Pte Limited (Singapore). http://iama.asia My web page is http://www.iama.asia

I have mediated many disputes in my practice areas, most often where the parties are legally represented. I have mediated over 250 matters since 2013 and I have represented parties in mediation on many occasions. The subject matter has included: environmental law; urban and regional planning; water rights; commercial disputes; personal injury insurance claims; land law including easements and rights of way, leases and disputes on the exercise of options and relief against forfeiture, mortgages and securities on land; corporate assets, boardroom disputes; Further details will be willingly provided if required.

Facilitative. I have evaluated issues only where the parties specifically agree. By facilitative I mean encouraging an understanding of the issues and interests of all parties to ensure an effective resolution of the matters in dispute by the parties to the mediation. My approach is to understand the matter and the positions of the parties. Preparation for mediation in my view is crucial for many reasons including an ability to approach a matter as mediator with understanding and empathy. I ensure that any agreement reached at mediation will work. I generally achieve that by reality testing and detailing the workability of the agreement.
