Mediation Profile

François serves as a mediator in international and domestic matters including commercial, civil and employment disputes. He´s the co-founder of Convirgente, the first conflict management consulting company in Portugal and of Neuroawareness, one of the first consulting and training companies dedicated to the application of neuroscience to negotiation, conflict resolution and management. Since 2011, Francois has been training executives, lawyers, ADR neutrals (mediators and arbitrators) about the application of neuroscience to their practice. With an engineering background, Francois has over 25 years of experience as business executive in global companies (Philips, Hitachi, Microsoft) as well as in his own start-ups (Hitit, Convirgente, Neuroawareness). As the GM of Microsoft Network in France, Francois launched the service and developed strategic contents and technology partnerships with Telco and Media companies such as France Telecom, TF1 and Lagardere. As a Digital Marketing VP of the Internet services and consulting company he founded in France, he managed the development and promotion of complex websites. He also drafted the business plan and drove the fund raising from ABN-AMRO and La Compagnie Financiere Edmond de Rotschild. He has a strong experience in marketing and commercial matters; transactions including mergers and acquisitions, contracts, retail and wholesale distribution; product development and marketing agreements; shareholder agreements, joint ventures, and strategic relationships.

François has served as a mediator in various commercial, business, technology, and employment related disputes in Portugal, France and Australia.

François believes that how he should act as a mediator should be defined jointly with parties and counsel. He puts a lot of emphasis on the preparation phase, especially with counsel, in order to help the parties to come to the discussion table with a good understanding of where they are with their case and how they could be helped: what kind of process, which role for the mediator, which style (facilitative or more directive), etc. François has a natural sense of humor and authority that he uses when appropriate. He is able to leverage his strong multicultural background, being a French descendent of Italo-English and Polish grand-parents, who lived in France, Portugal, Australia, and USA, who travelled in more than 40 countries, and who is an expert in diversity in terms of age, gender and culture. Last but not least, he puts his extended knowledge of neuropsychology at the service of the parties in a totally transparent manner, helping them to optimize their mediation process from an emotional, social and cognitive perspective.

For any case with a value of the claim superior to 1M€ and for international disputes, €350/hour For cases below 1M€ and for non-international disputes: fee per session and per party depends on the value of the claim as follows: * Below 15.000€ : 500€ * Between 15.000€ and 500.000€: 750€ * Above 500.000€ and below 1M€: 950€ * Case management fee is 250€ for each party. A session can last up to eight hours with a one-hour lunch break.

* Mediator and judge at the ICC competition in 2010 and 2011 * Applying neuroscience to negotiation and ADR (2011-2013): one day workshop taught in various cities in Europe and North America to more than 200 lawyers and ADR neutrals, in partnership with Bar Associations, ADR institutions and Law schools. * Intercultural and International Mediation training (2013): 3-day workshop delivered to 28 lawyers as part of the School of Mediation of the Paris Bar Association * Certificate Program in Applied Neuroscience for Legal and ADR Professionals (2010-2013): 14-session and 21 hours online training delivered 7 times to lawyers and neutrals from all continents.
