Review by Jainil Bhandari, 7 Mar 2023 I have known Mr Prakash for more than 30 years as a leading legal practitioner in his field, arbitrator and mediator. His deep knowledge of the law, quick understanding of the disputed issues and concerns of the commercial parties coupled with the ability to effectively communicate workable solutions all make for a formidable proposition as mediator. His engaging and sincere personality easily engenders the trust of the parties which is crucial in achieving a settlement of the dispute in any mediation. I have appointed Mr Prakash as arbitrator and mediator in many commercial disputes and will not hesitate to recommend him to my clients as mediator in future cases.

MR JAYA PRAKASH by MOHAMED GOUSH MARIKAN, 6 Mar 2023 Mr Prakash is an eminent member of the Maritime Bar and is a much sought after advisor by both legal practitioners and key industry players. His many years both as a successful advocate in maritime/shipping/admiralty law matters and as an experienced advisor to major P&I Clubs and shipowners provide a valuable source of guidance and help for parties who wish to resolve their disputes amicably. I deal mostly with complex maritime disputes including ship collisions, grounding, ship construction and oil/petrochemical claims. In most (if not all) of these cases, an independent and experienced mediator who not only have the skills to appreciate the legal issues involved but also the technical knowledge to comprehend the complex factual matrix is absolutely crucial if the dispute is to be successfully brought to a settlement by mediation. Mr Prakash is one such mediator. I have engaged Mr Prakash in the past to mediate a major collision matter which occurred off the Traffic Separation Scheme in the Singapore Straits. Parties were very far apart on both liability and quantum when the mediation commenced. Mr Prakash was however able to bring parties closer together on both issues through his patience, very good listening skills and understanding on the technical points parties were canvassing in support of their respective cases. Unfortunately, despite his best efforts, the matter was not resolved but this was entirely due to the unrealistic expectations of the parties rather than the quality of mediation. Although he managed to significantly narrow the differences and brought parties so much closer on the issues than they ever were, parties were simply not able to bridge the final gap in their positions. Despite the result, my clients were very happy with the quality of mediation Mr Prakash brought to the table and have expressed their intention to use him in the future should the opportunity arise. On my part, I have on many occasions in the past for my other cases, put up Mr Prakash as the nominated mediator and will continue to do so in the future.

Bazul Ashhab by BAZUL ASHHAB, 1 Mar 2023 A good mediator is a subject matter expert and an excellent listener. To facilitate a settlement, the mediator must garner the respect of the parties and must also demonstrate that he understands and is acting in the best interests of the warring parties without favoring one against another or having his own agenda. I have used Mr Prakash in many complex commercial disputes. He was able to achieve the above mentioned qualities expected of a good mediator without effort. Clients were very impressed with Mr Prakash. His continued experience as an commercial arbitrator have him see the issues without clutter and his personality and sincerity makes him a very safe choice if parties decide to mediate even in very contentious matters.

Feedback digest by Singapore Mediation Centre (SMC), 3 Oct 2018 Mediator: Jaya Prakash Reviewer: Singapore Mediation Centre (SMC) Date: 16 Dec 2016 This Feedback Digest is based on 19 feedbacks from 5 mediations that took place since October 2011. Feedback from these recent cases affirmed Mr Prakash as being an impartial mediator. Most parties agree that Mr Prakash had given them full opportunity to express their interests/ concerns and voice their views of the disputes. Mr Prakash was again noted for putting focus on the reasons for the parties’ demands, their interests and concerns; and not pressurising any one party to accept any settlement at any point during the mediation. Most lawyers and parties think that the professional background and mediation skills of Mr Prakash have contributed positively to the mediation process. They feel that Mr Prakash was a sensitive and empathetic mediator who fully understood the issues raised. In cases where settlements were reached at the end of the mediation, the parties felt that the outcome was evenly balanced since they had a say in determining the outcome. These satisfied parties noted in the feedback that they will recommend Mr Prakash as a mediator. They also agree that mediation has greatly helped them reduce the time and money spent in pursuing the matters further. Whereas in other cases where only some issues were settled, the parties felt that Mr Prakash was somewhat effective in getting them to understand their positions and interests, and in facilitating the settlement. In addition, some lawyers think that their discussions with Mr Prakash was the most favourable aspect of the mediation.
