Mediation Profile

John is an ex-director and consultant ADR specialist at Bowman Gilfillan Attorneys. He has BA and LLB degrees from the University of the Witwatersrand and is also a director of Conflict Dynamics cc. He is a member of the advisory Board of the African Centre for Dispute Settlement at Stellenbosch University and is a member of the Executive Committee of the South African National Dispute Resolution Practitioner’s Council. John also serves as a member on the International Mediation Institute's Independent Standards Commission. He specialises in dispute resolution and the training of negotiators, mediators and arbitrators and is a Centre for Effective Dispute Resolution (CEDR UK) accredited mediator. He co-designed the conciliation and arbitration induction training for the CCMA and has trained many of South Africa’s employment and commercial mediators and arbitrators for the past 15 years. He was a member of the International Labour Organisation’s team of international experts appointed to design mediation training for developing countries and he regularly trains mediators from countries in Africa, Asia, Eastern Europe and South America. The International Labour Organisation has also commissioned John to design training material and to train parties and trainers from countries across the world in mutual gain negotiation. This training material has been translated into French, Portuguese and Arabic and is used extensively throughout the world. He has written extensively in journals and other publications and recently co-authored the Second Edition of “Labour Dispute Resolution” and the First Edition of "Commercial Mediation - A User's Guide" published by Juta.

Over the past 20 years he has arbitrated and mediated some of the largest labour disputes in South Africa and he regularly facilitates negotiations, strategic planning and transformation processes. He has mediated approximately 200 disputes.

Training and Education

John Brand is an accredited mediator with the Centre for Effective Dispute Resolution (CEDR UK).

John Brand specialises in dispute resolution and the training of negotiators, mediators and arbitrators: - He co-designed the conciliation and arbitration induction training for the CCMA and has trained many of South Africa’s mediators and arbitrators for the past 15 years. - He was a member of the International Labour Organisation’s team of international experts appointed to design mediation training for developing countries and he regularly trains mediators from countries in Africa, Asia, Eastern Europe and South America. - Recently John has focused on training and facilitating joint negotiation teams in mutual gain negotiations. The International Labour Organisation has also commissioned John to design training material and train parties and trainers from countries across the world in mutual gain negotiation. This training material has been translated into French, Portuguese and Arabic and is used extensively throughout the world. He also co-designed and co-presented the Certificate course in Negotiation and Mediation at the University of Witwatersrand, 2009 and 2010.

I am covered by GLENRAND M.I.B PROFESSIONAL SERVICES Bowman Gilfillan : Professional Indemnity and Misappropriation of Trust Money and/or Property Insurance. Cover:- The cover currently afforded to Bowman Gilfillan attorneys in terms of the Scheme is R3 125 000 in the aggregate and this remains unaltered until 30 June 2010. Bowman Gilfillan have arranged additional Professional Indemnity and Misappropriation of Trust Money and/or Property Insurance for Bowman Gilfillan attorneys commencing 1 March 2009 to 28 February 2010. The Professional Indemnity cover afforded is R750 000 000 each and every claim in excess of the Attorneys Fidelity Fund Scheme policy. The Misappropriation of Trust Money and/or Property cover afforded is R200 000 000 in the aggregate. In addition to the abovementioned cover the Directors and Officers extension limit is R15 000 000 in the aggregate with two reinstatements and Fidelity Guarantee R2 000 000 in the aggregate with one reinstatement.
