Mediation Profile

Kitty Duell serves as a full time mediator and trainer/coach in a wide variety of disputes relating to domestic and international matters. This includes commercial, civil and employments disputes. She is a certified Netherlands Mediation Institute (NMI) mediator and accredited mediator for court connected mediation. Next to that she is a certified Restorative Practice Facilitator. She is a member of the Netherlands Mediator Association and serves in its counsel of Recommendation. She is last year’s recipient of the award for extensive work she has done for mediation development in The Netherlands. With 17 years experience as a financial and economical adviser and as a broker for (para) medical practices she became a mediator in 1999. During her carrier she developed an appreciation for the need for dispute resolution in business and was already practicing “mediation” as part of her negotiation and communications practice before her accreditation by NMI. During 2006-2007 she was interim manager for the independent mediation provider ACBMediation Corporate Conflict Management. She has specialized herself in performing mediations that hold a, potential, criminal component. This includes International Parental Child Abduction cases, sexual harassment cases, personal or work related injury claims, Her unique research into the competencies of effective mediation models featured in her master thesis is regarded as the first substantial research project of its kind.

For the last 10 years she has worked with mediation within and between companies. This has given her a wide knowledge of the essence of business conflicts and know-how to overcome the obstacles to reach a solution that serves all involved parties' needs. She has developed conflict management systems as a conflict prevention tool as well as a reintegration tool after burnout, personal injury and long-term illness situations.

Mediation is on one side about achieving the best results for all parties and on the other side transforming the parties' relationship in order to sustain a positive reputation in order to be able to do business in the future and to sustain the company in general. In this light the various styles (evaluative, facilitative, narrative, transformative and restorative) are all tools that the mediator should use where appropriate. Next to the mediation styles knowledge from NLP, systemic analysis, psychology and cultural differences are used effectively to help parties reach their goals.

Since 1999 mediation experience is build in some 100 different business and family related disputes, including complex cases involving national and international parties and complicated multi-party disputes. This business experience covers both in-house disputes and those between business parties. and I have also coached both staff and management in the field. I have designed and implemented conflict management programs.

Currently working as a co-author with Canadian and United States mediators on book regarding Cross Border aspects in International Child Abduction situations.
