MEDIATION CASE EXPERIENCE
• Successfully mediated over 2,700 civil mediations, before, during and after litigation.
Specializing in complex, multi-party litigation including business litigation, construction
defect, products liability, medical malpractice and wrongful death.
• Several hundred business/commercial cases involving breach of contract, business/corporate matters, shareholder disputes and corporate dissolutions, trade secrets, unfair competition, bankruptcy, fraud, collections, and franchise and partnership disputes and
dissolutions (including several law firms).
• Several hundred construction, real property and land use cases including construction claims, defects and closeouts, land use, CEQA, environmental protection, earth movement,
homeowner associations, disclosure, exchanges, brokerage and fiduciary relationships.
• Over 100 employment cases including discrimination, workplace harassment, wrongful termination, whistle-blowers, and wage and hour claims.
• Over 100 entertainment, new media, intellectual property and technology cases,
including cases involving film, television, music, and computer games and software.
• Several hundred other general civil cases, including insurance coverage, intellectual property,
health care, legal and medical malpractice, probates and trusts.

Mediator, arbitrator and trainer who is fully knowledgeable on different styles and approaches to address each individual case. Operate under a facilitative approach to help guide parties into collaborating with one another and finding a suitable agreement to their problem. When necessary, or when the case calls for it, will focus more on an evaluative approach to help the parties come up with a solution.

$10,500 per “All Inclusive Day” - Mr. Berman’s “All-Inclusive” service for the
full day mediation includes: one pre-mediation conference call with counsel, all study time including reading briefs, travel time, reasonable expenses, and the full day mediation session until midnight, if necessary
(after which additional fees will apply).

$6,000 per “All Inclusive Half-Day” - Mr. Berman’s “All-Inclusive” service for the half-day mediation includes: one pre-mediation conference call with counsel, all study time including reading briefs, travel time, reasonable expenses, and the half-day mediation session of up to 5 hours, starting or ending at 1:00 p.m (after which additional fees will apply).

Extra Time - $800/hr

ANY PARTY REQUIRING A CHANGE TO A CONFIRMED APPOINTMENT: A Minimum Fee of $750.00
