This Feedback Digest is based on 63 feedbacks in an unknown number of mediations since January 2008. In evaluating Mr. Berman’s post-mediation feedback surveys, it is evident that participants for whom he acted as mediator highly recommend him and the mediation process. The statistics from sixty-three participant evaluations of his most recent cases show that all parties would use Mr. Berman as their mediator again in the future and almost all (98.1%) said that they would all recommend him to others. The outcome of his mediations bore a high percent of cases that ended in a full agreement (75.8%), and those that ended in partial agreement (11.3%) stated that the mediation brought them closer to settlement. Nearly all parties expressed that the mediation expedited the outcome and lowered the overall cost of settling the dispute (94.9%). Quite a few people expressed their gratitude for Mr. Berman’s ability to listen and understand each party’s needs and to find a quick resolution that is satisfactory to both parties. In the feedback that Mr. Berman received his rating was excellent in understanding issues and expediting the outcome. Those who experienced Mr. Berman’s abilities in mediating complex issues remarked that he was able to quickly grasp the issues and persistently worked hard to find an agreement. The majority of people were unmistakably aware of Mr. Berman’s kindness, honesty and fairness, and some even noted that these characteristics helped persuade some historically forceful and unyielding lawyers or parties to collaborate and find a solution. Mr. Berman’s professionalism and preparedness was evident through his high rate of success in closing cases with full agreements. His easy going and gentle attitude, which was consistently noted in the feedback, helped both parties contribute to the outcome of the dispute, making agreements fair and workable for all members. He was also rated excellent in protecting confidentiality and maintaining neutrality throughout the case, which parties noted was essential in order to have them work together towards a common ground. In addition to that, parties also praised Mr. Berman’s management and organizational skills, noting that he was always fully prepared and ready to work as long as it took to resolve the problem, as well as meeting every person’s needs. A number of Mr. Berman’s skills are noticeable through the feedback received. The one that was continually reported was his ability to understand the psychological and emotional aspect and to help the participants find a quick resolution. His patience and understanding of the issues was remarked as being some of the main reasons for his ability to help the parties resolve matters efficiently. His approach was also noted as helpful in getting both parties to collaborate with one another to find a common ground. Several people also noted his skills in facilitating the parties to stay on the topic and focus on resolution. No reportable negative comments have arisen out of the mediations conducted by Mr. Berman within the past year. Richard Millen
