I expect parties to take mediation seriously and participate in good faith. It is critical that all necessary parties (corporate representatives) participate, preferably in person at the mediation session, but at least be available by conference call. If a contract is at issue, all corporate signatories to such agreement should participate in the mediation if they are still affiliated with the organization(s). I believe that successful mediation requires more than "shuttle diplomacy" and that active involvement of the mediator is crucial. I believe that it is critical to listen to what the parties are saying and what they are not saying. When appropriate, I will propose solutions to problems. When appropriate, I will confidentially evaluate the strengths and weaknesses of parties' positions when in caucus.

REIMBURSEMENT/RATE/COVERAGE ISSUES FOR HEALTH CARE SERVICES; EMPLOYMENT DISPUTES IN THE HEALTH INDUSTRY; DISPUTES BETWEEN PARTIES, WHICH MUST, FOR A VARIETY OF REASONS CONTINUE TO DEAL WITH EACH OTHER (SUCH AS A DISPUTE INVOLVING THE SOLE OR A MAJOR COMMUNITY HOSPITAL AND/OR A PAYOR/INSURER WITH SIGNIFICANT MARKET SHARE); REAL ESTATE DISPUTES, ESPECIALLY THOSE WHICH ARISE AS PART OF A DISPUTE OVER A BROADER BUSINESS TRANSACTION AND THOSE WHICH INVOLVE SPECIAL- PURPOSE REAL ESTATE SUCH AS HEALTH CARE FACILITIES.

$575 Per Hour
Hourly rate applies to conference, study, travel and mediation session time plus disbursements (travel expenses, conference call fees).

Cancellation policy: Reserve the right to charge $1500 if cancelled 4-10 business days prior to session, $2500 if cancelled 3 business days or less prior to session. Often waive cancellation fees if only a single day session is cancelled and especially if the parties resolve the dispute on their own prior to the session.
