This Feedback Digest is based on 72 feedbacks in 52 mediations initially submitted as of 2003 and up to and including August 27, 2014. The results of the mediations carried out by Martin Brink which were referred to him by the Court were without exception to the satisfaction of the parties. The evaluation forms rendered very positive feedback on his performance as a mediator. Martin Brink has proven to be able to mediate in a great variety of disputes. From issues about branding and advertising, non-competition covenants, issues of corporate governance and differences between management and shareholders or between shareholders themselves as well as issues about relocation of companies, issues between the national government or local government agencies on the one hand and private enterprises on the other (e.g. a settlement was reached between the Dutch Ministry of Health and the company introducing the so-called Supersmoker (electronic cigarette) into the market concerning an advertising code), issues about earn outs, franchise agreements and all sorts of other issues have been mediated successfully by Martin Brink. Recently he mediated in a global environmental case, enabling entrepreneur and financers to find a solution for their problem. Parties mention as his special strength that Martin Brink speaks the language of the parties, both entrepreneurs and private parties and has the quality to listen to parties involved. He is not afraid to address issues which are sensitive of nature or difficult and he has proven to be able to guide parties from a labyrinth of emotions and problems into mutually accepted businesslike solutions. His patience, sensitivity and positive attitude towards both parties in a mediation is highly appreciated. One of the parties says: "A combination of legal skills, legal experience, authority and optimism make Martin Brink an excellent mediator", and: "Indepth view on mediation goals represents skills and characteristics of Martin Brink, that helps him to observe, analyse, explain and contribute to the solution of the problem to an extent that makes it possible (after a while) to communicate and operate without him". It is noted that Martin Brink is especially capable of acting as mediator in cross border situations because of his language skills. He is fluent in Dutch, German and French and is a sworn Dutch/English and English/Dutch translator. The Reviewer has attended a number of mediation sessions in which Martin Brink acted as mediator and has reviewed the evaluation reports of the parties involved in 52 mediation cases (as of 2003 up to and including August 2014).
