Mediation Profile

Michael Cawlina serves as a Mediator and Arbitrator on construction related cases. He is a member of the American Arbitration Association National Roster of Neutrals serving on its panel of Mediators and as an Arbitrator on its large, complex case panel. Mr. Cawlina also serves as a Mediator for the Los Angeles Superior Court ADR Program. Mr Cawlina is currently the President of large construction company and has previuously served as the Executive Director of Disney's Construction Management Division; Senior Manager with International firms such as Bovis, Perini International and Walt Disney Imagineering.

Over 38 years of construction experience as an Owner, General Contractor and Construction Manager. Mr. Cawlina has served as a Mediator on over 150 cases. Experience includes large complex construction projects (building, industrial, commercial, residential and heavy), with specific expertise in day-to-day construction operations, dispute resolution and claim negotiations, the bid and award process, scope of work disputes, deficient work, scheduling, pricing claims and contract administration.

Experience includes overseeing construction of Disney's Shanghai Resort, a $5.5 billion project covering an area over 3.7 square kilometers, including 100 buildings/facilities. Other notable projects include the $750 million, 3000 room, Venetian Hotel and Casino in Las Vegas; the $168 million Expansion and Renovation of the Rose Bowl; the $700 million, 3.1 million square feet, Ronald Reagan Office and International Cultural Trade Center Building in Washington, DC.; the $273 million Caruso Affiliated Mixed Use Project. International experience includes Disney's Shanghai Resort and Hong Kong Projects; Euro-Disneyland in France; Embassy construction in 12 African countries and the construction of a new airbase in the Sultanate of Oman.

Types of cases include: breach of contract; wrongful termination; scope of work disputes; defective or non-compliant work; failure to perform in accordance with an approved schedule; over inspection; failure to grant timely time extensions; inefficiency claims; constructive change; and quantitative evaluations.

Facilitative: Mr. Cawlina initially adopts a facilitative style to define the issues, guide the process from opening positions to mutual interests, and to explore creative problem solving options. Evaluative: Mr. Cawlina offers evaluative approaches when the parties wish to draw upon his subject matter expertise or when appropriate for overcoming impasse.

Construction

$425.00 Per Hour. Hourly rate includes study time.
