An advocate of over eight (8) years experience, I am currently a practicing partner at the firm of Ahmednasir Abdikadir & Company Advocates as litigation, family, commercial, and conveyancing advocate.

I am a partner at the firm and manage the Mombasa branch which I set up and oversee operations.

I also head the mediation department at the firm and have since established the firm's mediation practice.

I have founded Khan MediationServices where I offer mediation services, training, and consultancy on conflict management.

I am a trained Professional mediator and Chartered Mediator having handled numerous matters. I also am accredited by the Kenyan Judiciary as a Court Annexed Mediator.

I am a board member at the Institute of Chartered Mediators and Conciliators of Kenya.

I am a Trainer of Trainers (TOT) and do train professional mediators.

In the year 2015, I joined the Commission on Administrative Justice, Office of the Ombudsman as a legal officer and worked for two (2) years.

For the two (2) years at the Commission on Administrative Justice, Office of the Ombudsman, my role included inter alia providing alternative dispute redress for complainants who lodged their complaints on administrative malpractices at the commission. This included for example delay or non responsiveness  of public officers in service provision to members of public in which case we were trained to mediate the dispute to reach an amicable resolution.

 

  1. A CHILD CUSTODY DISPUTE

A child custody matter ensued after our client failed to return the minor after holidays back to the mother since the parties had separated. The matter came up for hearing at the children’s court. As advocate for the defendant, I requested the parties to try mediating the matter to avoid a long and costly legal battle. Parties agreed. The mediation brought to the fore the fears of the father to leave his daughter to live with the re-married mother and a step-father within a one bedroom house. It emerged that the mother also had the same fear but did not want to lose her child.

The mediation process resulted in an agreement between the parties that the father could have custody of the child on condition that the mother gets unlimited access and also gets to keep her during school holidays. We recorded this in court and the matter was settled by consent.

 

  1. LANDLORD- TENANT DISPUTE

The tenant was issued with an eviction notice to vacate but declined to do so and continued occupation without paying rent for 4 months. The Landlord alleged that the tenant had too many guests all the time and who consumed liquor and drugs which annoyed other tenants. It emerged that both parties wanted to end the tenancy but the only quagmire was the date, the landlord insisted on 16th February while the tenant wanted 20th February. Parties finally agreed and tenant vacated on 18th February and Landlord got possession and refunded tenant’s deposit.

50 Hour Professional Mediation Training by MTI East Africa from 11th to 15th September 2017 and attained a Certified Professional Mediator certification.

50 Hour Advanced Mediation Training by MTI East Africa from 1st from 5th July 2019 and attained an Advanced Mediator Certification.

Trained Trainer of Trainers with MTI East Africa and became a certified professional mediation Trainer

I teach and mentor young students in schools on mediation as well as carry out sensitisations on the concept of mediation
