Mediation Profile

Patrick Walker qualified as a mediator in 1997 and is both CEDR and ADR accredited. He works as a mediator independently (see www.imediate.co.uk) and is on the In Place of Strife (IPOS) panel of recommended mediators. He handles a wide variety of commercial disputes including very high value and multi-party disputes. He has experience with international disputes and mediation requiring translators.

Patrick has over 30 years’ experience as a barrister and since 1999 has worked for Hammonds solicitors as Directory for Advocacy and as head of the firm’s national Property litigation team. He also sits as part time County Court judge (Recorder – civil) and Deputy High Court Judge.

Patrick is recognised as a leading mediator by Chambers and Legal 500 Directories and has a high success rate.

During a period of more than 11 years as a mediator, Patrick has undertaken disputes ranging from domestic boundary disputes mediated between litigants on person on site, to multi-million contractual and compensatory claims mediated between large teams of advocates and experts.

Examples of recent mediations include:

•Multi-million pound claims arising out of compulsory purchase
•Damages for injury to valuable salmon fishing rights
•Damages arising out of pipeline installation
•Solicitors’ negligence claim in a variety of circumstances
•Restrictive Covenants
•Loan Agreements
•Solicitors’ partnership dispute

Calm, good humoured, and persistent, Patrick quickly builds rapport and is never afraid to use private sessions to challenge perceptions or to ‘reality test’. Clients have commented that whilst his experience as a part-time judge is helpful in understanding the scope of the dispute, Patrick’s approach is not ‘judicial’ but receptive, creative, and entirely focussed on the requirements of the parties. Feedback indicates that clients value Patrick’s careful preparation, quick understanding of the issues, firm hand, and determination.

Patrick gained a reputation at the Bar as a commercial and property specialist and is often instructed as mediator in property related disputes. However, he now mediates in a wide range of disputes including:

  • Professional negligence (particularly solicitors and surveyors)
  • Easements including rights of way and light
  • Restrictive covenants
  • Commercial landlord and tenant
  • Compulsory Purchase
  • Building disputes
  • Agricultural
  • Boundaries
  • Shareholder disputes

In addition Patrick has experience in areas as diverse as personal injury, nuisance, family and trust matters.

A ‘usual’ fee, which would be appropriate for most one day mediations including multi-party, and conducted anywhere in the United Kingdom would be £3,500 plus vat divided equally between the parties. The fee includes usual preparation and allows for the mediation to start as early as the parties wish. An hourly rate of £350 is applied after 6pm. Alternative fee structures are available to suit particular parties and disputes
