Mediation Profile

Terence Tan is currently Senior Legal Counsel at the Ministry of National Development (“MND”). As part of the Legal Services Unit, Terence supports the MND’s vital role in planning and developing the use of land by providing legal advice on a diverse range of matters, including including administrative and constitutional law, contract drafting and management, Government procurement, as well as statutory interpretation.

Prior to his posting to MND, Terence was a Deputy Director (Civil & Legislative Policy) at the Ministry of Law. As part of the Legal Policy Division, Terence was involved in steering substantive law reform and policy formulation in criminal, civil and family legislation, as well as the vetting of Government Bills to ensure that they reflect sound legal policy principles and are consistent with the Rule of Law.

Terence’s previous appointments in the Legal Service include: (a) serving as a Justices’ Law Clerk in the Supreme Court of Singapore, clerking for, inter alia, the Chief Justice and the Judges of Appeal; (b) serving as an Assistant Registrar of the Supreme Court in 2011, where he presided over hearings in chambers of a wide range of interlocutory applications, while holding a concurrent appointment as Magistrate of the State Courts; (c) serving as State Counsel/Deputy Public Prosecutor in the Attorney-General’s Chambers (Civil Division), where he advised the Government on a wide spectrum of legal issues.

Terence also has experience in academia, having taught Equity & Trusts at the Faculty of Law, National University of Singapore in 2012.

Terence earned his Bachelor of Laws (First Class Honours) in 2010 from the National University of Singapore and his Master of Laws in 2013 from Harvard University on the Singapore Legal Service Scholarship. He also received a Master in Public Policy from the Lee Kuan Yew School of Public Policy in 2010, where he graduated as valedictorian of his class and was awarded various prizes, including the Harwin Gold Award for outstanding academic performance.

Terence is admitted to practice in both Singapore as well as the State of New York, USA.

 

Terence is an experienced mediator who has mediated a large variety of cases, ranging from contracts to breach of landlord’s obligation and sale of goods.

Since 2015, Terence has also been giving back to the community by offering his mediation services pro bono as a Court-Appointed Volunteer Mediator at the State Courts, and has achieved outstanding settlement rates in the cases that he has mediated.

 

Training and Education

Terence received his training in alternative dispute resolution and mediation at Harvard Law School, where as part of his Master of Laws program, he also attended Harvard’s flagship Negotiation Workshop. Upon his return to Singapore, Terence received further training at the Singapore Mediation Centre, and was accredited as an Associate Mediator in 2014.

As a testament to his mediation experience and skill, Terence was also one of the youngest Singaporeans to be accredited as (a) a Certified Mediator by the Singapore International Mediation Institute (SIMI) (the top tier of certification available under SIMI), and (b) a Certified Mediator by the International Mediation Institute.

Terence has prior experience in academia, having taught Equity & Trusts as part of the Adjunct Faculty at the Faculty of Law, National University of Singapore in 2012.

Publications

While Terence has not published in the area of mediation, he has prior publication experience, having written on trust law in the past, namely:

a) Article – “The Irreducible Core Content of Modern Trust Law”, Trusts & Trustees 15.6, (2009) pp 477-493.

b) Book review – Trust and Asset Protection, Trust and Forced Heirship, [2011] Sing. J. L. S. 596.
