This Feedback Digest is based on 18 Feedbacks from 16 mediations, initially submitted in June 2009.
Parties and counsel who have used Judge Bassler would overwhelmingly use his services again and would, without hesitation, recommend him to others. Typical of the comments reflecting Judge Bassler’s acceptability are: (i) Judge Bassler was dedicated. He kept trying and working in a difficult matter; (ii) I have previously, and will continue to recommend Judge Bassler for mediation; (iii) Judge Bassler is one of the finest individuals I have ever had the pleasure to come accross in my professional career; (iv) Judge Bassler was committed to the process and was firm but respectful. He quickly grasped the issues and did the homework necessary to make the process effective. For this reason, I believe the process had a stronger liklihood of success, or at least provided value to the parties; (v) He had an excellent ability to digest and comprehend the voluminous factual record. He was calm with a balanced approach; (vi) Judge Bassler rolled up his sleeves, learned the material (including complex and wholly disputed damages analyses), and did a terrific job achieving a resolution. He is not only a highly skilled mediator, but also a lovely person with great people skills; (vii) He demonstrates the skills and temperament to be an effective mediator and has the experience and reputation to inspire confidence; (viii) Judge Bassler was terrific throughout the mediation and was very engaged; and, (ix) Judge Bassler used his skills to keep the negotiations moving, filtered out unhelpful positions, and guided the parties to a resolution where less experienced and less committed mediators would have been unsuccessful.
Judge Bassler’s mediation skills and abilities are rated as highly effective. Typical of feedback received in this regard are: (i) He was very good at listening and developing relationships with the protagonists; (ii) With a thorough approach, and an inate ability to have a party acknowledge both the strengths and weaknesses in their case, Judge Bassler employs the perfect balance to mediate claims to resolution. He is among the best I have ever used; (iii) He has patience with the process and the parties, exellent listening skills combined with an impeccable timing for interjecting himself into the process, the right temperament, and an ability to move parties towards compromise by intellectual means; (iv) His grasp of the underlying issues and perspective as a retired judge made a decisive difference in the outcome; (v) He is smart, practical and quickly saw the strengths and weaknesses of both sides’ cases and sought to leverage each; (vi) Judge Bassler clearly and very effectively grasped the merits of the cases and the dynamics in the room. His intellectual ability to grasp the facts and his terrific interpersonal skills enabled him to read the room and figure out how best to bring the parties together; (vii) His demeanour, common sense, patience, intelligence and experience made a decisive difference in the outcome; (viii) Judge Bassler was able to keep the parties on track and get many of the issues resolved while giving the parties every opportunity to reach an amicable resolution of all issues; (ix) He knows how to filter out bluster, gauge a party’s real positions, analyze the law, build trust, and selectively disclose information, all with an eye towards bringing the parties together in a way which makes both sides feel some pain but gets a fair deal done; and, (x) He has the ability to convey strengths and weaknesses of the party’s case and has exhibits patience in bringing the parties together.
Judge Bassler is also highly regarded for his ability to effect a positive outcome. For example, one provider of feedback noted that a case involving two infant plaintiffs, seven (7) insurance carriers and one self-insured defendant settled after only eight (8) hours of mediation. In my opinion, there are not many neutrals who could have achieved a resolution on such a case. I am amazed that Judge Bassler was able to get both the underlying tort action and the insurance coverage litigation resolved. While another noted that having a mediator as respected as Judge Bassler comment frankly on the weaknesses of our opponent’s case pushed matters toward a subsequent resolution of most points. Another example reflected that while not all of the issues were resolved, Judge Bassler contributed significantly in getting the parties to resolve many of the issues – he took charge when he needed to, and did not allow the parties to give up when they seemed incapable of reaching resolution.
Costs were widely reported as reasonable in the context of the value of the disputes mediated by Judge Bassler, and in general a very high degree of satisfaction was reported.
